General Terms and Conditions of GDPR-Map
The following General Terms and Conditions (GTC) shall apply to all services provided by stdout UG (haftungsbeschränkt), Grimmeisenstr. 19, 81927 Munich (hereinafter “stdout”).
Any deviating or supplementary terms and conditions of the customer shall not become part of the contract unless stdout expressly agrees to them.
1. Our Services
The scope of the individual services shall be determined by the respective service descriptions applicable at the time the customer places the order.
In addition to these General Terms and Conditions, specific terms may apply to individual services. Reference to such terms will be made in the respective service description, and the customer agrees to them upon conclusion of the contract.
The service description does not constitute a legally binding offer to conclude a contract, but merely a non-binding invitation to the customer to submit an offer to enter into a contract. By clicking the “subscribe with payment obligation” button, the customer submits a binding offer to conclude a contract for the service specified in the shopping cart.
A contract shall only come into effect upon stdout’s acceptance of the customer’s offer by means of a separate email, or at the latest upon commencement of service provision.
2. Prices and Payment Terms
stdout’s services are based on a credit system. These credits are used to limit and track usage. Each selected plan includes a defined number of credits per month. The credits included in the selected plan are billed monthly at the applicable plan rate. Any usage exceeding the allocated number of credits shall be charged additionally as follows:

The use of stdout’s services for commercial purposes is permitted exclusively upon conclusion of a paid subscription plan.
Free, non-commercial use is limited to 100,000 credits per month. If this usage limit is exceeded, stdout may suspend further use or require the customer to subscribe to a paid plan.
The available payment methods are specified on stdout’s website. All prices stated are final consumer prices in euros and include the applicable value-added tax (VAT).
The price for the selected plan is due for payment in advance, without deduction, at the time of contract conclusion. Fees for additional credits will be billed in the following month and charged using the payment method selected by the customer at the time of contract conclusion.
3. Grant of Rights
stdout grants the customer a non-exclusive right to use the data and scripts provided, limited in time to the duration of the respective contractual relationship. The customer is not permitted to grant usage rights to third parties or to sell such rights. Upon termination of the contractual relationship, the customer shall cease using the provided data and delete it.
Furthermore, the customer undertakes to comply with third-party data usage licenses, in particular the ODbL license of OpenStreetMap. The customer is responsible for ensuring compliance with all applicable data license terms.
Copyright notices and other markings associated with the use of hosted map tiles may not be altered or removed. The customer shall indicate on their website the ownership rights of stdout and OpenStreetMap Contributors. If the customer uses styles provided by stdout, they are also obliged to indicate the ownership rights of OpenMapTiles.org.ontract fee.
4. Availability
stdout performs regular maintenance work on its systems, servers, and databases in order to ensure network security, maintain network integrity, guarantee service interoperability, protect data privacy, and prevent disruptions to data retrieval. For this purpose, stdout may temporarily suspend or restrict its services, taking the customer’s interests into account, where justified by important reasons. Where possible, maintenance work will be carried out during periods of low usage.
If longer temporary suspensions or restrictions of services are required, stdout shall inform the customer in advance about the nature, extent, and duration of the impairment, insofar as this is objectively possible under the circumstances and provided that such notification does not delay the resolution of already existing disruptions.
5. Term
The term for all services shall be one month from the conclusion of the respective contract for the selected plan and shall automatically renew for successive one-month periods. Thereafter, the contract may be terminated by either party with a notice period of two days to the end of the respective term. If the customer fails to pay the amount due for the selected plan or for subsequently billed usage (credits), in whole or in part, or fails to do so on time, stdout shall be entitled to suspend its services immediately without prior reminder and/or without setting the customer in default.
6. Customer Obligations
The customer is obliged to provide all necessary information completely and accurately and to notify stdout of any changes without undue delay. This applies in particular to the customer’s address details, payment information, and email address.
The customer is responsible for choosing secure passwords for all services and access points, which are to be used exclusively for access to stdout. The customer shall manage their passwords and other access data with due care and keep them confidential from third parties.
7. Liability
stdout shall be liable without limitation where the cause of damage is based on an intentional or grossly negligent breach of duty by stdout or by a legal representative or vicarious agent of stdout. stdout shall also be liable for the slightly negligent breach of essential contractual obligations. An essential contractual obligation in this sense is one whose fulfillment is necessary for the proper performance of the contract and on whose compliance the customer may regularly rely. In this case, however, stdout shall only be liable for the foreseeable damage typical for the contract. stdout shall not be liable for the slightly negligent breach of obligations other than those specified in the preceding sentences. The above limitations of liability shall not apply in cases of injury to life, body, or health, in the event of the assumption of an express guarantee, or in cases of liability under the German Product Liability Act.
To the extent that the liability of stdout is excluded or limited, this shall also apply to the personal liability of its employees, representatives, and vicarious agents.
8. Set-off, Right of Retention
The customer shall only be entitled to set-off or exercise a right of retention if their counterclaims have been finally adjudicated or are undisputed.sk!
9. Final Provisions
The law of the Federal Republic of Germany shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
Any amendments, supplements, or ancillary agreements must be made in text form to be effective. This shall also apply to any modification of the text form requirement itself.
If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of performance and jurisdiction for all claims arising from the business relationship shall be the registered office of stdout. stdout shall also be entitled to bring an action at the customer’s general place of jurisdiction.
If the customer relocates their residence or habitual place of abode outside the territory of the Federal Republic of Germany after conclusion of the contract, the place of jurisdiction for all disputes arising from the contractual relationship shall be the registered office of stdout. This shall also apply if the customer’s residence or habitual place of abode is located abroad.
